1. Agreement to Terms

By accessing the website of Jensen Golf Carts, obtaining a quote, or purchasing a vehicle from us, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services or purchase our products.

2. Pricing and Quotes

All prices displayed on our website or provided in direct communications are quoted in South African Rand (ZAR) and are exclusive of Value Added Tax (VAT) unless explicitly stated otherwise.

• Official written quotes provided by our sales team are valid for 14 days from the date of issue, subject to stock availability and currency exchange fluctuations for imported vehicles.
• We reserve the right to correct any pricing errors on our website. In the event a cart is listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for that vehicle.

3. Payments and Deposits

Due to the high-value nature of our inventory and custom builds, specific payment terms apply:

• In-Stock Vehicles: Full payment via Electronic Funds Transfer (EFT) or approved financing is required before a vehicle leaves our showroom floor.
• Custom Orders: A non-refundable deposit of 50% is required to initiate any custom factory order or heavy modification. The remaining balance is due prior to final delivery.
• Goods remain the strict property of Jensen Golf Carts until the invoice is paid in full and funds have cleared in our nominated bank account.

4. Delivery and Risk

Delivery dates provided are estimates only. While we make every effort to deliver on time, we are not liable for delays caused by third-party freight companies, port delays for imported brands, or acts of nature.

Transfer of Risk: The risk of loss or damage to the golf cart passes to you (the buyer) upon delivery to your nominated address, or upon collection if you are transporting the vehicle yourself from our Cape Town showroom.

5. Warranties

New golf carts are sold with the respective manufacturer's warranty (e.g., E-Z-GO, Club Car, Yamaha). Jensen Golf Carts will assist in facilitating warranty claims, but the final decision regarding warranty coverage rests entirely with the manufacturer.

Pre-owned or refurbished carts are sold "Voetstoots" (as is) unless a specific, written dealership warranty is provided on your invoice at the time of sale. Any unauthorized modifications to the vehicle will immediately void all warranties.

6. Consumer Protection Act (CPA)

Nothing in these Terms & Conditions is intended to unlawfully restrict, limit, or avoid any rights or obligations created for either you or Jensen Golf Carts under the South African Consumer Protection Act, No. 68 of 2008.

7. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these terms or the purchase of a vehicle shall be subject to the exclusive jurisdiction of the courts of South Africa, situated in the Western Cape.
